DUMB DECISION BY CANADIAN JUDGE Neal Mulligan neal karenmulligan@rcn.com The Canadian courts do use English Common law to a greater degree than we do but it seems clear that the judge in this case has civil liability all mixed up with criminal acts. In civil cases it is between the two parties and one can be judged to have been so negligent as to cause the other person's behavior. So the more negligent party may escape penalty. In this case he would only give the money back. But in criminal cases the offense is against society, the contributory negligence of the victim doesn't, at least shouldn't matter. Very strange.
